On Wednesday, the Environment and Lands Court on Wednesday issued a warrant of arrest against Machakos Governor Alfred Mutua for contempt of court.

Governor Mutua is accused of failing to honor a court order issued by Machakos High Court Judge Oscar Angote.

Governor Mutua was on July 30, 2020 ordered by the Environment and Land Court at Machakos to pay businessman David Gitau Thairu Ksh.5,590,443.15 over a dumpsite case.

The amount entailed a decretal amount of Ksh.5 million and a collection fee accumulated to Ksh.590,443.15.

The order was issued in a suit filed against the county government for dumping waste in the businessman’s land.

Thairu went to court claiming that Governor Mutua had failed to honor the court orders.

Apart from paying the Sh5 million, the court had also directed the Governor and his county government to remove waste dumped into the parcel of land within Ikuuni hotel in Machakos town.

Machakos Governor Dr. Alfred Mutua has come out to defend himself after a warrant of arrest was issued against him by the Machakos Environment and Lands Court.

In a press statement by the Governor’s office, he utterly clarified that the warrant of arrest was not meant for him as a person but the County Government of Machakos reiterating that the county was going to pay the funds.

I have been notified of a warrant issued by the Machakos Environment and Lands Court for me to appear before it. I wish to clarify that the warrant is not directed to me as a person BUT to my office as the Governor of Machakos. This is normal in government. Further, the county lawyers who have been dealing with this matter are moving to court under certificate of urgency to set the orders aside. This is especially so because the county is willing to pay once funds are available and further that as Governor I’m not liable for the mistakes of commision or omission of officers in the county government. I’m a believer in the rule of law whose core tenet is obedience of court orders.

Machakos Police Station OCS has now been directed to arrest Governor Mutua and present him before the court as soon as possible unless he pays the said amount.

“You are further commanded to return this warrant as soon as it is executed or the money noted in the margin is tendered to you with an endorsement certifying the day on which and manner in which it has been executed, or the reason why it has not been executed,” wrote Magistrate CN Ondieki to the OCS.
